Do you really need an attorney to Sell Your Structured Settlement?

So, you’re looking to sell your structured settlement.  You’ve had some offers from companies.  You’d like to sell, but, you think you need the guidance of a professional.  You don’t want to pay the lawyer fees.  Maybe an accountant or maybe the company that wants to buy your structured settlement wants to provide a professional for you free of charge.

Here are some tips to consider before you take any action:

There are approximately 156 terms, requirements and considerations that must be met by you and the company that wants to buy your structured settlement in the eyes of the State of California and the Attorney General.  I know, I counted them.

Did you know there’s a law that states if the company your working with in buying your structured settlement doesn’t submit the proper paper work to the Attorney General at a designated time in a certain format, then you receiving any payments will be delayed significantly.  The judge can’t approve the sale until he or she receives that paper work back from the Attorney General.

Did you even know the other company had to submit paper work to the Attorney General?   What if they don’t submit on time?  Will there be a penalty?  Who pays?  Are you going to do battle with the company to hurry them up?    Do you think your accountant will have any affect?  A lawyer would. Eugene Ahtirski would.   A lawyer would love to put the full-court-press on anyone that tries to mess with their client.

This link below is the proof to my above statement.  Scroll down and read the law for yourself; it’s 10139, then look below it and read (a).   The link is to a widely used website called leginfo.ca.govYou can tell from it’s URL that it is a part of the California Government.  The Legislative Counsel of the State of California puts on this website.  This is the law making branch of our government and this is where you will find the current laws for the state of California provided by the State of California.  This is the legal source for the public’s right to know about the laws that govern you.  It’s easy to be looking for a URL that states “Californialaw” or something obvious like that.  Seeing the “leginfo” can throw a person off into thinking this is some private website.  It’s not.  It’s the law.
