IF YOU ARE A SELLING A STRUCTURED SETTLEMENT – YOU NEED TO READ THIS!
Regardless of how simple the TV commercials and web-ads make it sound, any sale of a structured settlement requires Court Approval! What this means is that if you are thinking of a selling your structured settlement, you must first go to court and get a judge to approve the sale.
More important, the judge must also make the decision that selling your structured settlement is in your best interests, or the sale of your structured settlement payments will be denied. Fact, this is true no matter where you live in the United States.
So, what should you do? The best advice is to get a lawyer to represent you in the sale to act as your independent professional advisor. Because a lawyer that understands the process will insure that you are getting the amount possible for your structured settlement payments, negotiate between buyers on your behalf, and will assist you throughout the Court process. Statistics also show that people that go into Court without an independent professional advisor have a greater chance of getting their sale DENIED!
Best of all, if you pick the right independent professional advisor, you may not be required to pay the attorney directly as most state laws allow for the lawyer to be paid by the purchaser. And in states, where that is not allowed, a good lawyer trained in the area of structured settlements can still figure out how to work out a way to keep you own costs to a minimum, while getting you far more money for your payments than you could have obtained on your own.
So, don’t be fooled by the tricky sales pitches, or the cute commercials, selling your future payments is a legal proceeding, and both the buyer and the seller should have a lawyer to represent their client best interests. And that is what we do!
